Here are 2 scenarios:

 

  • An apprentice leaves employer after gateway and immediately starts with a new one (so just for EPA), but old employer is happy for apprentice to finish and pay the completion fee (and all fees really). New employer is happy to support with EPA. Would it be possible then to leave the learner with an old employer (on paper) or we have to change it officially?

 

  • An apprentice leaves employer and starts with a new one just before gateway but old employer is happy for apprentice to finish using their account while all EPA documents are done by a new employer. Do we have to transfer an apprentice to new employer? 

I realise that the answer is probably that we have to change employer, but is there a way around it? In case if old employer is happy to pay and new one isn't , but happy to support.

You must report the reality of the situation including any change of circumstances in the ILR and the Apprentice must continue to be employed under an Apprenticeship Agreement until the EPA is completed.
