ECF 5 - FS Level 2 CoF Exemption

Hi All,
I have noticed we have a learner in the ILR who has the ECF5 marker indicating they hold an FS level 2 but they're still coming out on the condition of funding report as 'Doesn't have English, not studying English'. Am I missing another criteria that the learner needs to meet? This is not the case across the board as there are learners in the CoF report showing as exempt through holding an FS L2.
