37 year old with limited leave to remain

Came into the country on 09/11/20 - visa expires on 10/01/24.  The learner wants to enrol onto an ESOL course.

1. Is he funded?

2. I am assuming he will still need to pay the enrolment fee

As Limited Leave is not part of the exemptions to the 3 years residency requirement the learner would need to have been resident for three years prior to their start date.

Are they a EUSS national? If so, check which countries they resided in prior to 2020.

I’m not sure on your question re an enrolment fee as we shouldn’t be charging learners for their Course if you are receiving government funding for their course . That said based on the above if they are not eligible based on their residency you could charge them as a commercial learner based on what you feel is appropriate to deliver to them.

Kelly Knights agreed, however - ESOL aims are mostly Co-funded for AEB so a fee is usually expected.
