Could someone please advise on the eligibility of a British National (Overseas) - who has provided us with passport evidence to state they have Right of Abode in Hong Kong, but does not require certification or a visa to visit the UK (due to his BNO passport). The learner is Chinese, spending the majority of his time in Hong Kong and travelled between the UK and Hong Kong since 2019 (spending approximately 1 year in each location at one time). Are we right to assume he needs to meet the 3-year residency rule for him to be eligible? Thank you

Yes, very much so, BNO is somewhere between a work visa and a UK passport so, like both of those things, a learner would need to be ordinarily resident in the UK for at least the last three years to be eligible.
