To be eligible for apprenticeship funding the individual would need to meet the requirements in Annex A of the current funding rules:

The Biometric Residence Permit is an official document from the Home Office that shows the immigration status of an individual. You can use this information written on the card along with the rules above to determine if the learner is eligible.

The type is - settlement. In date. It doesn't mention the right to work.

Unless they are a EU learner that has settled status,‘settlement’ is generally the same as Indefinite Leave to Remain and they would be exempt from the 3 years rule. Thank you Kelly
