Return from BIL with us but re-start with a new Main Provider

Just wanted some advice on this one regards how I process on the ILR: we have an employer we have worked with for a while but org changes mean they are changing from us as their Main Provider to a new Main Provider (all under one roof as it where) for their Levy Funded Apprenticeships.

We have a number of learners on TLS L3 and ODM L5 with this employer, who we had to put on a BIL from 1/8/22 due to their operational pressures. They are now ready to come back to learning (still have approx 9 OPL months to go) but now with the New Main provider. Obviously they are still shown on the ILR with us but on a BIL. So given the above..... do I bring them back from a BIL then End them and show as a transfer using current date (e.g. 16/11/22)...... or do I just end them with us using the start of the BIL date as their end date & last day in learning with us and show a transfer on the ILR as I process the End? I would (in either case) then work with the new Main Provider to support them in bringing back the learner as a transfer/re-start but from lets say 1/12/22, which of course will require a new training plan etc and an extended (new) end date?

Any advice gratefully received.

Just make the BILs withdrawals on 1/8/22. They are *not* transfers. Transfers (in the ILR) are ONLY where a learner changes Standard with the same Training Provider. We shouldn't call anything else a Transfer!

You change the BIL code 6 to 3 for a withdrawal from the BIL date, the new provider follows the guidance here: https://guidance.submit-learner-data.service.gov.uk/22-23/psm/article/apprenticeship-recording-changes#article-Transfers%20to%20a%20different%20provider%20on%20the%20same%20or%20a%20different%20apprenticeship

Ok got that, thanks Steve; I was hoping that might be the case.

So the new Main Provider will bring them on as a re-start? apply a new Qual Plan/Start Date (but presumably show original start date with us somewhere) and a new End Date and do new TNP1 and TNP2 when they bring them on their ILR? Along with a new training plan etc?
