Supporting apprentice beyond planned end date

Hello all.  We sometimes find despite our best efforts, apprentices are going beyond their planned end dates and often it is because the employer is not giving them the necessary time to complete and they fall behind.  We wanted to ask if we would be entitled to include in our contract that if an apprentice goes beyond their planned end date we would charge the employer directly for any further support from us.  Would this be acceptable?  We don't want to pull the plug on our training/support but if employers don't pull their weight then we find our tutors are under a lot of pressure not only tutoring new apprentices, but also those that should have finished.  We hoped that if we could include a financial implication to the contract (payable by the employer and not part of the funding levy) then it will encourage the employers to ensure they work with us to ensure the apprentices complete in time or go on a break in learning if necessary.

You are expected to continue to support learners to completion even when past their planned end date as you have been funded to do so. It is not the practice to charge employers for any support after the planned end date and I would expect the ESFA to take a dim view if you implemented this but you can always check with them for confirmation.
