Maths and English within a L2 apprenticeship

Hi hoping to get some views on the following internal debate. 

Learner doing a L2 apprenticeship does not have any exemptions. Funding rules state we must study towards and achieve E&M of at least level one and then study towards the L2. However if the learner is initially assessed at L1/L2 already from my understanding we are not entitled to claim the funding towards L1. In these cases we put them on L2 but we are then being referred to the funding rules saying we should work towards L1 first. 

Easy answer is not to fund the L1 and then only fund the L2 when they progress but just wanted to make 100% sure we can't claim the L1 funding, they should be test ready but in some cases they still need work, reg, booking tests, certs etc which cost us.

You are correct. As the initial assessment reflects they are at already at L1/L2, you can't get funding for the L1 FS:

P141 We will fund Functional skills English and / or maths at level 1 or below where you (or a subcontractor) have conducted an initial assessment that shows the apprentice needs to study at a lower level before being able to achieve their level 2. The apprentice must be judged to be below level 1 to be funded for a level 1 qualification

...and yes, you can't claim for the cost of entering the learner for L1, should you choose to do so (and I certainly would!), but you've got to set that relatively trivial amount vs the 20% completion payment which you won't get if they struggle with L2 and haven't got an L1 cert...
