Break in Learning and change of employer

We have an apprentice who went on a Break in Learning from 12 October and then left their employer on 23 Nov after resigning because they had found another job.
The new job was due to start 5th Jan 23, but the apprentice then decided to turn this down and is now awaiting an offer of employment with another employer.
Question - now that we can use up to 12 weeks BIL for changes of employer, rather than withdrawing, when does the 12 week count start from in this scenario.
Is it 12/10 or 23/11?

Hi - our understanding (and the date we use) in this instance would be 12/10 - as that is the last date you can evidence progression.
