Upskilling Maths & English on an Apprenticeship

Good afternoon, a quick question on upskilling Maths & English, I have an employer pushing back on their member of staff working on upskills their Maths and English because they already have grade C GCSE in both, however, the IA shows that there are gaps in the learners Maths & English, I believe that we are required to work with and develop these skills as we have identified. However, I cannot find anything in the Rules to put in front of the employer, any ideas please.

No prior attainment takes precedence over IA so where they already have grade C GCSE they have met the requirement for M/E.
