EPA completion 20% to employer when apprentice withdraws?

We frequently have the situation whereby an apprentice will complete their training but will not sit the EPA. They do not see any incentive for doing so, despite encouragement from us as the provider and employer. This means we miss out on the 20% completion payment as they have effectively withdrawn. I wondered if any other provider had this problem and had tried to recoup the shortfall 20% from the employer? I cannot see anything in the funding rules from preventing us from doing so and the DfE has confirmed my understanding. Has anyone else done this or otherwised figured a way around the problem?
