FYI for future reference, the ESFA have finally responded to my query and have confirmed that we should select the level of the qualification if it is for something not specifically listed under that level in the manual.

Thank you Phil Dawe, that's what I thought but wanted to check with others in case I was being unfair. I asked the ESFA to confirm but their response was 'we provide the guidance, it is up to the institution to decide what they deem is the most appropriate evidence that the learner is required to provide'..... Thanks Martin West, I think my problem is that a 6 month leave to enter stamp in a passport doesn't confirm to me that the learner is here legally under one of these schemes.

Thanks Steve Hewitt, that's how I was taking it, the learner would normally enrol onto a course which is going to run for 3 terms at the start of the year and then the tutor would confirm the exact detail of the learning aim(s) they are going to study during that time.

This paragraph is quite misleading and we have always worked on the same principle too Richard Heath . Steve Hewitt please can I ask your advice, when it says 'where assessment has identified the learner cannot undertake one of the qualifications listed in p157', would you take this as they cannot undertake one of the qualifications full stop or is just at the point they are assessed - i.e they are not ready to work towards one of the qualifications yet but could be ready to take one at a later date in the same funding year once they have completed some non-regulated learning? If they can go onto a qualification in the same funding year, can they go back to non-regulated learning after completing the qualification as long as the non-regulated learning is at a higher level? Thanks so much for that Steve Hewitt -- I really started to doubt myself - it does seem unfair that if they are a spouse of someone with ILR/ILE then they are eligible without 3 years residency but not if they are a spouse of a british citizen.

Hi, I know the QAR will exclude the job outcome/employment outcome aims but what criteria do people use when deciding if a learning aim can be flagged as an employment outcome in the first place? Is it just where a learner has withdrawn from the programme, was unemployed when they started the programme and has signed a self dec to confirm they have now found a job of at least 16 hours or more a week and have been in that job for four consecutive weeks? Does the learners ILR employment status record also have to show they were in receipt of an unemployed benefit as per the QAR criteria for you to claim a job/employment outcome payment - i.e could you end up claiming job outcome/employment outcome payments for a learner who is not excluded from the QAR because their ILR employment status record does not match the QAR exclude criteria? Hope that makes sense!

Thanks for posting Phil Dawe, that's really helpful. I don't understand why the records are only available for 21/22 onwards when the funding rules were the same in 20/21........ :-(

I would be interested in the ESFA's response to this too, we had assumed it was self declaration as the rules don't explicitly say we must have seen evidence of the learners status. If we need to see evidence then this will change our enrolment process.
