I think that's a bit of stretch myself...over the years I have seen many Providers try to stretch this particular point. Indeed, I remember being marched in front of a College Principalship that were a Lead Provider of ours (at a previous Organisation I worked for) to justify why we were claiming LSF for Hay Fever! There's enough pickles to avertedly get into in this Sector without creating potential new ones, so my advice is the same as I gave Pupils at Give Way signs, as a Driving Instructor...If in doubt...Don't!

Thanks for your input Ruth...the Rule updates to the NSF and the April 22 flexibilities have been written in a similar way to their residency rules...far more complicated than they need to be. If the single word 'available' was taken out of 132.2 it would have a totally different meaning, but as it's there, I am obliged to read it the way I have, I believe.

I don't believe you need to, although if there is some doubt about the Employer's commitment to employing the Apprentice as long as it take for them to reach EPA, it would be a good idea, in order to tie them in. On this occasion you may decide to change the usual saying to..."if in Doubt, DO!"

Yes; I made the point because the original poster asked "...would they be fundable, whether an EEA national or not?..." so I was clarifying that if they happened to be an EEA national, leave to enter and 3 years would not be sufficient by itself without proof of their EU settlement status. (Also, if you are turning away a lot of EEA nationals who are just at the application status you may want to reconsider) Don't you just LOVE the Residency rules?! :)

Hm. In my view the learner's OTJ "work" is the end product of the OTJ training delivery by the provider, so if you can clearly evidence the delivery (rather than the output) that should be sufficient. This may include a learner log of the time spent producing the work/output.

If they are an EEA national then they need to have obtained (or at least applied for) Pre-settled/Settled status under the EU settlement programme too. So leave to enter alone, would not be sufficient. That is my understanding anyway; if anyone can point me to something that contradicts this, please do.

It may be worth checking that the ESFA Contract for 21-22 has been signed and returned by whoever should have done, within your Organisation, as if not, the ESFA may well be waiting for this. We had a similar issue with another aspect of the R01 Process due to this.
