Thanks Ruth Canham-James this is really helpful i think on the basis this is a mistake and all affected learners are in the current funding year the easiest way to change would be to simply reduce the current TNP1 by the EPA price and put this in the TNP2 box - same overall total and the data will be correct moving forward Thanks so much for your help

Does anyone have, can recommend or is willing to share a Written Agreement/Contract for Services that is not a 400000 page Contract document that would scare the living daylights out of an SME who is looking to take on an apprentice? Shame the ESFA do not provide a template like they do for Commitment Statement and Apprenticeship Agreement - would make life a whole lot easier and standardised

Kelly Knights is spot on here and this line makes it pretty clear: "It also includes individuals who are self-employed or supplied by an employment agency, unless those individuals are working under your direction and control, in the same way as your own employees" An associate works under your direct control and therefore even if not covered under a contract of employment/PAYE etc would not, IMHO, constitute as a subcontractor. Quite frankly if it did it would put 100s of people out of work as ITPs frequently use "Associates" to deliver training, assessment, IQA etc etc

Yeah I tried tagging people in using '@' but didn't work! Jessica - it was a very supportive audit. My opinion is the ESFA team involved were cognisant and, where they were able to be, sympathetic of the issues that providers have faced in light of Covid. They were equally supportive in highlighting our good practice and providing feedback on areas for improvement that we as a new provider will definitely be taking forward to enhance our short and longer terms delivery plans Hope this helps
