The issue I have with that advice is I have to put male or female, those being the only options in the ILR. 'Whatever the learner says' opens a much wider field of options. When we ask the learner to pick one of two binary options (and it causes offence) our approach has been to quote the ILR definition of legal sex. This usually works reasonably well, if only in the sense of shifting the blame to the DfE. It does help if our staff are consistent in how they interpret legal sex, however.

Surely a critical point we need to flag to the ESFA here is that they are completely ignoring devolved authority rules with this error at the moment. That is just unacceptable as more and more providers are working with devolved contracts. We do not have time to add (and possibly later have to remove again) DAM codes to thousands of records that are coded correctly according to the published devolved authority rules.

The other scenario I'm unclear about is a 19-23 year old eligible for FF because they don't have a full L3, who is unemployed and not looking for work, and not on benefits. From my reading of this in the unemployed definition: not receiving any benefits, wants to be employed, and you are satisfied identified learning is directly relevant to their employment prospects and the local labour market needs. In order to claim full funding for learners who are unemployed and not in receipt of benefits, you must indicate that they earn below the earnings threshold by using LDM code 391 and FFI code 1 They wouldn't meet the unemployed definition. They don't meet the new earnings threshold definition, because they're not employed or self-employed. In this case, I'm not clear that we should be using LDM 391.

Has anyone managed to understand how to code a 19 - 23 doing a L3 who does not already have a full L3? In the v2 update of the rules it says: Learners aged 19 to 23 who have not previously achieved a full level 3 qualification must be fully funded, regardless of the earnings threshold or employment status, if they choose a qualification from the level 3 legal entitlement or FCFJ list. You must not charge them any course fees. However, further down we get: use LDM code 378 and FFI code 1 to claim for funding for 19 to 23 year olds learners, who have not achieved a full level 3 and earn above the earnings threshold use LDM code 378, FFI code 1, and LDM code 391 when recording learners who meet the earnings threshold criteria or are unemployed, or are 19 to 23 years old and have not achieved a full level 3 These two seem to contradict each other for a 19-23 year old without a full L3 but earning over £25K and give no clues how to code one who is unemployed or earning under £25K. I'm lost.

I was advised to wait and it eventually processed, despite the original claim that the reports had failed. I feel that is misleading and it would be better if it said it was backlogged.
