Thanks Ruth They're not on a student visa - its a skilled worker route. They've been her 4 years and the only thing it says she cannot do is access public funds -which seems to be only relating to accessing state benefits

Hi Ben, I don't have a response to your question - but would be interested if you had a reply from DfE if you also raised this with them - as this is this is something we have also been discussing at length. If the answer is that we would lose all funding then why would a Provider pay out for any costly assessments before 42 days? Tracey

Hi, just seen this post We have been adopting the change of employer approach on return from BIL however that has caused us lots of DLOCK07 issues - I've just watched the webinar mentioned above and it doesn't cover the complexity of how to actually do it within the ILR to make sure that the new employer is set up when they return from BIL - for example if they go on BIL 1/11/23, change employer on 5/1/24, but then don't return from BIL until 19/2/24. In majority of cases we only find out they changed employer just before they are due to return from BIL / then we've got to ensure the new employer is prepared to support & sort out necessary required documentation which takes time and could delay the return from BIL even further? Thanks Laura, I understand what you are saying but as the employer change only went through in 23/24 for 22/23 I think this may be where the issues lies in our Bud ILR data return.......will pick this up with them....

Hi everyone Thanks for your replies - Interesting paragraph Martin I would interpret this to be that if any of these changes take place whilst in learning then they don't apply, rather than if they have withdrawn and returned some time later to restart the programme after these changes have already happened / been updated on provider systems....
