Apprentice at Gateway changing job role.

Hello, 

I have a  situation arise with one of our apprentices that is at Gateway but is leaving their apprenticeship job role with their employer and going to a bank staff position with the same employer. The bank staff role will be like the permanent role they were doing so the roles and responsibilities will remain the same.  The employer has already agreed to continue to support the apprentice through gateway when they move roles, if allowed.

The first issue is, the expected ILR practical period end date was recorded as 15/09/2023, but they are completing earlier 16/03/2023. The overall apprenticeship duration will still meet the minimum of 12 months and 1 day.

The other issue we have is that the apprentice is due to go travelling for a approximately one month at the end of March, before taking up the new bank role and then completing their EPA.

So, my question/s are, will they be able to complete the EPA with the change in roles? and will a BIL need to be recorded even if they have completed the practical period early and are at Gateway?

I'd say, as long as they're still technically employed throughout, they should be fine to do the EPA. I'd ask the employer to make sure the bank contract starts immediately after the other contract finishes, even if they're away travelling. That shouldn't be an issue if it's a zero hours contract.

Them completing early isn't an issue as long as they did over a year, plus they met the minimum OTJ for the actual duration. If they did less OTJ that originally planned, you'll need to follow the process to get that agreed and signed off by the employer (in the guidance).

You don't need a BIL if they are already at gateway before they go travelling. There's no learning to have a break from. You should already have recorded an Actual End Date. There's often a big gap between Actual End Date and Achievement Date.

Thought this would be the case, but I wanted to check and make sure that this would be ok, under the current funding rules.

Thank you, Ruth. No I won't. This particular employer knows not to stop apprentices unless told by us to do so (change of employer etc.), or the apprentice leaves/ withdraws from the apprenticeship.
