Hi, we have an apprentice who started in Sept 21 - he was enrolled to FS in the Oct, but somehow he attempted the tests a couple of weeks prior to his start date for FS - this has only come to light as he is being entered for gateway.  How can we rectify this in the ILR?

Has he been attending functional skills classes for those 20 months? Did he pass on those attempted tests?

Yes he did attend classes, but didn't sit a test after the failed ones prior to his start date - if he needs to sit tests again we will have to delay entering him for gateway.

I'm not sure what the question is then. If he failed the tests prior to all the delivery he did with you, that's not relevant. If he's been doing delivery with you, you'd have been planning for him to sit the assessments before getting to gateway anyway? If he's a Level 2 Apprentice, and he already has Level 1 FS (or equivalent), then it's not critical he sits L2 tests anymore (though really should if you've been delivering for 20 months). If he's a Level 3 apprentice without L2 FS (or equivalent), then he can't be at gateway until he passes.

The funding rules state there following:

P140.2 Where the apprentice already holds approved level 1 
qualifications: 
Apprentices must start, continue to study and take the 
assessments for a level 2 English and / or maths 
(Functional Skills level 2 or GCSE). This requirement must 
be fulfilled before the apprentice takes the end-point 
assessment. Apprentices should be assessed at level 2 
for all three units of the English Functional Skills and the 
assessment for maths.

So if the tests he sat prior to his the start date can't be used, then he will need to sit further tests, I was just hoping there would be a workaround?

Sorry yes, my mistake, they only don't have to sit the tests if they didn't already have a level 1.

No, the tests done before he started with you don't count. You've had 20 months to deliver the FS, and you must enter him for the assessment. If he fails, he would still then be able to sit EPA for a Level 2 Apprenticeship.
