If you pick a different standard (new "versions" are still the same Standard), the funds received for the first one aren't relevant, so you can claim band max.
If the employer feels the first provider hasn't delivered, they need to fight that out with the provider to see if they can get some money back. ESFA have previously said they won't intervene, as the employer should have been keeping better track, though I'm sure they'd be interested if there are providers out there doing this a lot.

Hi,
We are potentially taking a transfer learner that hasn't completed the amount of work to reflect the duration on the Level 3 Teaching Assistant. Can I just check - are we able to negotiate a cost or do we only use the remaining funding?
Is there potential to start them again on the new standard?
