Hello,

I have a potential 16-19 traineeship start (July) that has not been in the UK for 3 years, they have a Residence Permit with a "Dependent Leave to Enter" stated on it.  My instinct is they are not eligible to start, but I am being asked to check myself.  I don't believe any of paragraph 40 in the 16-19 Funding guidance applies but am confirming that with the individual.

Please could someone offer their opinion.

40.a isn't it? You'd need to see their parent's visa, but seems likely that they will have leave to enter or remain if that's what their dependant has...

Or, if not that, then 40.d would likely apply if their parents are working?

Thank you Steve Hewitt, I don't want to get it wrong to disadvantage the individual but can't risk the funding.  We get so few that the process is not familiar to us.

My rule of thumb is that if they're 16-18 on 31 Aug, and they're in the UK legally and not on a student visa (or on holiday), they're fundable. There's almost no circumstance when they wouldn't be. How would they legally be here without parents/guardians, but not on a student visa or an asylum seeker/refugee? It's highly unlikely. Paragraph 40 covers almost all eventualities.

And if you get someone ***super*** weird (not in the banned categories), you can always ask to fund them.

Thank you both, I will hold my hands up and say I was wrong, which I don't mind as it's in the learners best interest.
