If a learner is on a study programme spanning 2 years made up of National foundation diploma in Year 1 and a National Extended Diploma in Year 2 would they still be eligible for 16-18 study programme funding if they were 19 on the 31st August of the 2nd year of the study programme?

Nope, they should be on the Ext Dip from day one with a two year span of start to end.

Also, hope this isn't L3 or it's likely Year 1 will take out their FL3 entitlement as well, so they won't be AEB fundable Year 2 (depends on the aim given how complex L3 is now...)

Sometimes FCFJ for a student unemployed or low wage can rescue you from that scenario!

I double check around December each year that none of our 18 year olds (or 19+ students being waived as first full level 3) have been accidentally put on a one year qual, when they intend to do two years on that level, and we correct them if we have any. I know that's too late now, but it's a useful thing to do every year.
