On an Apprenticeship or Not on an Apprenticeship ?

Hi, just after confirmation really, we have a large cohort starting in September.  Three of the learners have not lived in the UK for 3 years prior to the apprenticeship programme commencement date and don't meet any of the exemptions.

They are being commercially funded by the employer, if they don’t meet the apprenticeship requirements I'm assuming they can not be registered for an apprenticeship, they won’t go on the LET/ILR, they don’t need to evidence maths/English or OTJ (we may still ask them to upload learning journals to demonstrate reflections and how they are putting learning into practice in the workplace), and won't need to take EPA, and won't obtain an apprenticeship certificate ?

Just want to confirm we're making the correct assumptions !

Well, this is kind of up to the employer? We can totally record non-funded/commercial App programmes in the ILR using funding model 99 if the employer wants them to do the EPA and get the certificate.

If they're *just* doing the training though, then no, wouldn't need to go anywhere near the ILR.

Thanks for the reply Steve, we use "99" for Welsh and Scottish Apprentices.  Could we treat them the same even though they haven't lived in the UK for 3 years ?

Unfunded is unfunded (99), whether Welsh or from outside the UK. 

If you're a College and not an ITP, you're obliged to record all your delivery in the ILR, even if unfunded and/or not doing the EPA.

Thanks both, we're a training provider, I'll liaise with employer to see if they want the App Cert.  I presumed because of the 3 year rule they weren't eligible for an Apprenticeship but I should have been thinking they aren't eligible for a FUNDED apprenticeship.

Employer funded Apprenticeships are recorded on the ILR and need Maths/English where these are a requirement of the standard as is the EPA and they will be issued a completion certificate by the ESFA when they are recorded on the ILR as unfunded (Funding model 99).

An unfunded apprenticeship has to meet the requirements of the standard and its assessment but would not meet the requirements for funding as in the funding rules.
