Restart Apprenticeship Standard from beginning with new provider

We have a prospective learner (transfer) who has been on an apprenticeship programme with another provider for 17 months. The existing provider has not delivered the elements of the programme during this time to a high standard or quality and consequently when the employer has looked to transfer the apprentice to us and we have performed a skills assessment, the learner has scored low and is in need of covering 80/90% of the full programme again. The employer is trying to request permission from the ESFA that the learner can be funded again for the full programme from their levy but does anyone know how likely is this and do the funding rules provide for this in any form (by way of ESFA agreement)? The employer has put a formal complaint about the provider into both the ESFA and DfE but it seems they are showing little interest in obtaining a refund in part or full for the employer. There is very little funding left of the funding band maximum so a refund of levy or permission to re-fund the entire programme from the ESFA would be necessary for the transfer to happen.

I have never seen anyone successfully claim more funding. All the default systems just don't allow it. When this happened on a large scale at one provider, ESFA basically said it was the employers' fault for not monitoring progression (granted that was years ago). One option is for the employer to stop the DAS record back to July 2023, that would claw back anything from Aug 2023 onwards at least. That then potentially also puts them on the wrong side of the contract though, so not ideal. They could ask for a cash refund from the first provider, and could use that to pay you over and above what's left in the band. The other solution is to find a different Standard, which isn't often possible. It's a horrible situation 🙁 If it's an employer you want to work more with, it can be worth delivering at a loss.
