Hi all,

  Just a sense check on the ILR spec for the Small Employer: attribute field

I'm assuming this is only ticked for prior April 1st 2024 starts who are working for an under 50 employer and aged 16 to 18, or 19 to 24 with EHCP.

Post April 1st 2024, i'm assuming this (small employer ILR field) is no longer used as 16 to 21, or 22 to 24 with EHCP who work for non levy employers are not considered a small employer (?)

Response I got from ESFA helpdesk on 13/05/24:

The Specialist Support team have been in touch today to let us know:
 
For the 16-21 year old cohort, you no longer need to record the SEM code. We are currently in the process of updating the Technical Funding Guide so that this aligns with the recent policy change. For the 22-24 eligible apprentices, for the time being you should still use the SEM code in this instance.

Since they did finally decide to all non-levy 22-24 EHCP after I asked this, that last bit no longer applies and 22-24 EHCP will automatically be exempt if employer is non-levy, so basically, no need for the small employer flag at all for starts from April 2024 😊

Sorry to piggyback onto this thread, can anyone confirm that all 16-21 apprentices with non-levy paying employers are not required to pay co-investment, regardless of employer size (over 50 employees).
