Hi, 

We have a prospective apprentice who was born in Hong Kong and moved to the UK in 2022.  Looking at 283.3

'Have permission granted by the UK government to live in the UK and such permission is not for education purposes only' 

Does this mean we can ignore the 3 year rule once we have had sight of his visa?

Sadly probably not if they're 19+. We've had a number of Hong Kong students on BNO passports, but we can't fund them until they've been here 3 years. The list of 3 years exemptions is quite specific in the guidance, and this isn't one of the reasons. Even a British National who has lived outside of the EU for many years, and only returned a year ago, is not fundable if 19+.

If they're 16-18, they're almost always funded as long as they aren't here specifically to study.

We currently got a student who was fundable last year because they were 18, but has now become unfundable for a year because they're 19, but has only lived here for 2 years. That's a tricky one to explain to them!
