I think that's probably just an ILR Spec oversight. We're record LOU for any employment status entity with an unemployed status (I even have internal validation that won't let anyone add an unemployed record without LOU), and the employment status entity is required for funding model 11.
Our system generates an xml file with the LOU in, regardless of funding. It seems needlessly complicated to actively exclude LOU just because a student doesn't have any aims that are 35, 36, 38, 81 or 99.
Agree that the Spec is most likely the document that incorrect for exactly the reason you've stated here, and that it's just not consistent with what they've required for adults for the last X years.
Likely they removed FM10 and forgot to replace it with FM11. I have contacted the ESFA and also recommended that our in-house systems support team contact the external system provider.

ESMType_08 - ILR Spec and validation don't agree for FM11

We appear to have discovered a discrepancy between the ILR Specification and the validation rules for FM11 over length of unemployment.
Spec does not list FM11 as needing this field. Therefore our system is not returning this field for FM11 learners.
This triggers ESMType_08 "The Length of unemployment has not been returned" , as FM11 is not one of the two funding models that has a exception in the ILR validation (FM25 & FM82).
Is anyone else encountering this?
