Yes, on the basis that the obligation is from the apprenticeship start date, not the practical period start date.
62. Every apprentice must be paid a lawful wage for the time they are in work and in active learning. The employer is responsible for paying the apprentice’s wages and complying with national minimum wage regulations.
62.1. The employer must only use the apprentice rate of the national minimum wage from the apprenticeship start date (see paragraph 59) and not before.

Can i check apprenticeship wages with you.
If an Apprenticeship Agreement is signed from their contract date ie 1st September so we have done all pre enrolment and accepted them on programme , but their practical doesn't start until 1st November, this is the 1st day of learning, can the employer pay the apprenticeship wage as they have filled their apprenticeship placement and just waiting on the course to start?
