Subcontracted 1619 Apprentice doing full cost course

We have a learner that is a 16-19 year old doing an apprenticeship with another provider who subcontracts to us for some delivery elements. Said learner would like to enrol on a part time evening course with us, can they choose to do so and pay in full? I know they can't be a 1619 learner with us. I'm looking at the funding guidance which states-

 

a) tuition fees cannot be charged to students aged 16 to 18 in full-time or part-time education by either ESFA-funded institutions or their subcontractors. For the purposes of the funding agreement and this guidance, ‘18’, means under 19 on 31 August in the teaching year when the student commences a study programme

I would suppose they are in part-time ESFA funded education but with someone else, are we allowed to charge for our own delivery?

Bit of a catch-22 this. You definitely can't claim study prog and app funding at the same time, but, as an organisation with study prog funding, you definitely can't charge a 16-19 year old fees...

Thanks for the reply Steve, so even if the learner wants to pay to do a course that would be highly beneficial for them so they can't? I suppose the logic is that one only needs so much education at a time funded or not and it would encourage providers to offer some courses as paid only creating a wealth based inequality for 16-19 learner?

Roughly this, yes. Wasn't traditionally a thing, but has been since the introduction of Study Programmes which outlawed learners being claimed for by two institutions at once.
