Hi, from https://www.gov.uk/government/publications/apprenticeship-technical-funding-guide/apprenticeship-technical-funding-guide-from-august-2023#Coinvestmentwaiver (my bold):
Where an apprentice changes employer (after 1 April 2024), and remains on the same apprenticeship, then the following will apply if the original start date is:
a) prior to 1 April 2024, then the co-investment waiver will not apply to the new employer (the new employer will be required to pay co-investment)
b) on or after 1 April 2024, then the non-levy status of the new employer (when the apprentice begins their new employment), and the age of the apprentice when they started their apprenticeship (with the original employer) will determine whether we waive co-investment
Sounds like point (a) applies in your case.

Levy to ESFA to Non-Levy transfer

Hi there,
We have a learner who was made redundant from a Levy employer in September 2024; now funded by ESFA. We have found them a new Non-levy employer to complete their two-year apprenticeship. The learner is 21 - would the new employer have to pay the 5% employer contributions - as the learner started on the old rule of when EC was at age 18 years?
