30 days - Break in Learning - 12 weeks

Hi, we have an Apprentice that walked out on her Employer at the beginning of December 2024. She had 30 days to find another Employer but has been unsuccessful.  Her 30 days expired on the 04.01.2025, do I use this date to put her on a break in learning or do I use the date she was last in learning with us or the date she left her Employer?  Does the 12 weeks also start from the date I use to record the break in learning?  TIA Helen.

We'd put the early December date, but I don't feel 100% confident on that. What if they've been doing college lessons in that time? I guess since they weren't employed, and they didn't meet the 30 days rule, that makes then technically not an apprentice during that time, even if they were studying? I'd also say the 12 weeks starts from early December. I'd be interested to hear if anyone has been told different by the help desk/an auditor.

We have registers when they are in training with us so I am thinking it might be better to use a date when she was last in learning rather than the date she was with her Employer.  Do you know if the 12 weeks are counted from her break in learning? Thanks Helen.

Yes, I would use the date you have a register for unless you have work she has submitted. Yes, 12 weeks are counted from her break in learning, same date.

Thank you for your responses.  I actually sent this message as a query to the ESFA helpdesk and have been told that The Break in Learning would start from the end date with the previous employer and the 12 weeks would commence from that date. Helen.

I did also explain that we may not have evidence only word of mouth for when they last attended work. They have said whilst there is no requirement in the funding rules for evidence to be collected, it may be advisable to ask for a P45, resignations letter or a letter stating termination of employment.
