Within ASF, the rules are that they stay as the funding status that applied when they started the course. A co-funded Level 2 adult doesn't become fully funded part way through if they become unemployed and eligible for full funding. I'd apply the same to a change of eligibility across funding streams.
If they came back for a new course next year, then they'd be 16-18 funded.

We were advised by Keith Standing that we could change a student to 16-18 funding if they were issued an EHCP part way through the year when I asked for a student of ours in Feb 24.
"I think it would be reasonable to treat the student as a 16-19 funded student for the whole funding year (once an official EHC plan is in place with you as the named provider). I am assuming the needs that justify the EHC plan were in place for whole year and your assessment processes seem to confirm that.
If you claim funding for whole year any fees paid by student should be returned to the student.

E&M would still be required if the planned hours exceed the 150 minimum to meet the CoF rules, unless your SEN specialist deems it acceptable to exempt them for this year based on their learning needs identified in their EHCP. Alternatively, you could accept and record the reason why they aren't enrolled for E&M and absorb with in the 5% tolerance allowance.
That's interesting, and not surprising from Keith, he always gives very pragmatic advice. The only trouble is when an auditor disagrees with you and you don't have it in writing 😕 It's definitely reasonable to treat them as EHCP from day one. I think I'd be asking ESFA directly if we had this, though you might get a different answer depending on who you ask.

Hi, looking for a bit of advice on a unique situation please.
We have an adult learner (21 YO) attending an adult FE course since the start of the year. They have, as of today, been approved for for an EHCP, therefore making them eligible for 16-18 funding. However, as the course they are attending is one of our adult courses, there is no provision for English and maths for condition of funding compliance. The course is also low on hours too, so the learner cannot achieve full time hours.
I am unsure whether we should be updating the learners funding, as at the time of enrolling and based on the information we had at the time, they were an adult funded learner and it's only now that they would be funded as 16-18. What would others do? Would it make a difference if the hours were more or less than 150.
