Employer with DAS permissions has left the company

Please can someone help me! We need an employer to stop a DAS record as the apprentice has changed employers.

The old employer is saying they don't have DAS log ins and don't know who has in the organisation.  I have directed them to the helpdesk but as they no longer employ this apprentice, they are not prioritising actioning this stop. This stop is causing a DLOCK so I would like to get it resolved asap. Anyone have any suggestions please how to resolve?

Report them to the Apprenticeship Service and explain that they're refusing to comply, send them details of the conversations you've had. They can stop it for you, but will only do it as a last resort.

Presumably they know they're causing problems for their former employee and they're just not bothered? You won't be able to let the student continue for long with the new employer if the old employer doesn't sort it out. Would the apprentice be prepared to contact their old employer and tell them what problems they're causing.

Our contracts include something about the employer being liable for costs if, by their action or inaction with the DAS, they causes us to lose funding. You could potentially invoice them for the funds you can't access from the new employer if you have something similar?

It's absurd that employers can do this with no consequence. There should be a banned list with the Apprenticeship Service, of employers that are not allowed to take on apprentices.

Thanks Ruth, its so frustrating. The number of issues I am trying to resolve with DAS locks is absurd!

You can request a stop directly on DAS, they will then email the person with control of their account and if they don't action the stop or reply to DfE within something like 2/3 weeks, a stop is automatically applied. 

You just need to try to add the learner and when it comes up with the message saying they are already on a programme, it gives you the option to request a stop. (If you get the message about there already being a record with that email address, just remove the email address and try again to submit).

Thanks Callum,I have requested the stop via DAS but its not been actioned. I have added the learner to their new employer but its causing a dlock error due to the old employer not actioning the stop.

I wasn't aware that the stop will automatically be applied after 2/3 weeks?

I forgot they added that feature, which is weird because I was really excited when they announced it 😂 I just don't think I've seen it in action yet, and I don't believe you get notified, you have to keep checking.

Hi - just to update on this. The stop was actioned as I received an email notification. I am unsure if the employer did this or the apprenticeship service as I requested the stop via DAS. Anyway its resolved and cleared the DLOCK!
