I assume this is a "have completed less than 75% of the apprenticeship practical period specified in the apprenticeship agreement and the remaining training represents a training duration of six months or more" situation? If they'd already done more, you can just keep funding until the end. As per the funding rules paragraph 356, you have to withdraw after 12 weeks. I do agree it's totally unclear because it says "new employer is not found within 12 weeks", which they clearly have found. The key bit is that the guidance does say that ESFA will fund only for 12 weeks, so if they haven't yet signed the agreement and training plan etc, they're not an apprentice with that employer yet so you can get funds from them, but you also can't get funds from ESFA/DfE anymore. I said in another post earlier this week, I wish they'd reword these bits of guidance to make it clear that they have to be signed up as an apprentice, not just "employed".
If I encountered this, I'd be telling the team to withdraw 12 weeks after redundancy date.

Hi,
We have a learner who was made redundant at the end of January 2025. We amended his ILR to reflect this and have been receiving government funding for him since then. He has found new employment but his new employers haven't yet made the decision whether or not to support him to complete his apprenticeship and the 12 weeks are now up. Can we put him on a BIL from his redundancy date or do we have to withdraw him?
