16-19 EFA - Withdrawal and Reinstated

Hi,
A SEND learner enrolled on a 'Foundations for Life' non-regulated provision, was withdrawn at the start of the academic year due to lack of attendance and other health issues. On the insistence of his parent, he was then reinstated in January, but did not return to learning until this week (28/04). I am a little concerned about whether he should return in this academic year, given that he will not meet his planned hours, as well as the changes around his ILR. There is some guidance around this, but given that he was withdrawn for a number of ILR returns and then reinstated, can we justify it to the agency? Thank you

Similar thread here from a few months ago Aashish. We wouldn't let a learner go more than 4 weeks without attending unless you have really hard evidence to back it up, doctors appts, referral letters, meetings with parents etc to show some form of intention to return.

That is really helpful. My case is a little different as this learner has only attended 5 days in total so far, but there was a conversation with their parent, which can be evidenced. I would also be looking to amend their planned hours, given the lack of attendance. But besides that, my main concern is not allowing them enough time to complete the qualification as well as overclaiming their planned hours

Has the learner even hit their funding qualifying period?

Not yet, given the programme is planned for 24 weeks or longer, he will still need to attend 37 days to meet the qualifying period. Which I think answers my own question...
