If they're not in the ILR, and therefore you're not claiming DfE Funding, I assume the employer paid in full already? In which case, the rules about not charging the employer don't apply I'd have thought. I can't imagine there's any way to just claim some Learning Support funding from DfE.
I assume DfE know you're delivering apprentices that you're not including in your ILR? That's something I'd definitely raise with our account manager.

Circumstance where you can charge employer for ALS support?

We have learners who are off ILR for security reasons. One of these has been identified as benefiting from Additional Learner Support.
Can you advise whether we can draw down funding for this support? If so, what is the mechanism when the apprentice is not on the ILR?
Alternatively, can we charge the employer for the support?
