Levy transfer for apprentice we are training

When Levy transfers were introduced there was a rule for Training Providers that you could not use a transfer from your Levy to pay for an apprentice you would be training. I believe that this rule was later dropped- can anyone confirm?
Yes, we do it, but I made a big deal of it being very clearly in the contract that they are not required to spend that levy transfer with us as the provider.
