Hi All

A bit of an odd one which appeared straight forward but the more I think the more confused I am...

Functional skills are not classed as off the job hour and therefore not 'protected' in the same way, which opens the following questions 

Would the employer need to pay the apprentice when they are attending functional skills sessions. 

Do functional skills sessions need to be in work hours or could they been in an evening or at weekends?

These all hypothetical questions but initial I think the employer would need to pay the apprentice but then I think more and maybe they don't.

I think I may just be overthinking this and going round in circles and the answers are clear but would be fab if someone could help me out of the current spiral of thoughts

As you've rightly pointed out, English and maths are not considered off-the-job training, however, where it's a mandatory element of the apprenticeship, employers should allow the apprentice to complete it during normal working hours. I can't actually find this written down explicitly.. but I think you could pretty reasonably infer it from the funding rules where it states that the training plan must include:

96.11. Written confirmation from the employer that the apprentice will be allowed to undertake off-the-job training within their normal working hours, in addition to English and maths standalone qualifications if required.

As such, if it's during working hours, they'd also need to be paid..

Edit: Granted, I concede you could say I'm making a semantic argument..
