Apprenticeship English and Maths Gaps

One of our Apps Managers was asking me what to do if an apprentice hadn't attended any English/maths for 8 weeks. The plan was for E&M every week for x number of weeks. The guidance says:

45.2 The provider is responsible for ensuring that active learning for English and/or maths takes place in line with the signed training plan.

But what should we do if that doesn't happen for some reason? I can't find anything in the guidance. There's no indication that we follow the same rules as for OTJ active learning. The guidance is clear that OTJ active learning and E&M active learning are now completely separate things. The guidance about breaks when there's no activity in two calendar months very specifically refers to OTJ active learning. Do we assume the same applies for E&M, even though it doesn't say that?

Also, I had completely missed the addition of this rule for 25/26, and haven't seen anyone talking about it. It's not in any of the blue "New for August 2025" boxes.

140. Where it is agreed that the apprentice will study towards English and/or maths, providers must ensure active learning for English and/or maths takes place in line with the signed training plan. Where the apprentice is aged 16-18 the plan must include a minimum of 55 guided learning hours per subject (this is in addition to the hours required for off-the-job training).

140.1. The only exception to this is where it has been identified, within the initial assessment, that due to prior knowledge the learner requires less than 55 guided learning hours in order to be ready to take and pass the assessment(s) (see paragraph 138.3) – in these instances this must be documented on their training plan. 

That's an odd rule, it basically says, "you can't do x except when you can". If we identify prior learning which means we do fewer than 55 hours, then I guess we need to record that as Funding adjustment for prior learning?

The approach we've adopted is that if they miss 1 scheduled session then we aim to re-plan and catch-up on their next scheduled session, if they miss 2 consecutive sessions we close them aim down and restart when learning commences (we plan for monthly delivery), the hope being that having this as part of our documented delivery arrangements doesn't cause the 1st missed session to be deemed a funding error, as like you, we've interpreted the guidance to be that the E&M is split from the OTJ and thus the re-planning & BIL guidance for OTJ doesn't necessarily apply to E&M.

RE 140 - This portion of the guidance is specifically for foundation apprenticeships and was lumped in with blue text stating that this (foundation apprenticeships) is a new section being added so probably not a rule that's of concern to the majority of providers who aren't delivering foundation apprenticeships. Technical funding guide advises to reduce funding where prior learning is identified for functional skills.

Thank you so much for pointing out that the 55 hours is in the Foundation Apprenticeship section, I completely missed that. Too quick with the Ctrl+F without looking at the header!

I'll have a chat with the delivery team about options for E&M gaps. I think we could justifiably use breaks, which means we then don't need to calculate funding remaining every time (and I can see some apprentices having multiple gaps, making a right mess). We just need to set some internal limits on what's too big a gap.
