Change of employer at gateway

Created

An apprentice has completed their practical period and is preparing to enter gateway, however, they have changed employer (within 30 days). The EPA will be taking place with the new employer so will a new apprenticeship agreement and training plan need to be completed? I'm assuming no as all training has been completed? we have completed all other documents such as employer sign up paperwork

If the practical period has finished, they are already at gateway. The guidance definition of Gateway (aka Final day), is last day of delivery.

I wouldn't do anything with the training plan as that's basically finished. With the agreement, I think it might depend on whether the new employer is taking responsibility for completion payment. They can do, but they no longer have to

351.2. Where an apprentice has changed employer after they have completed all the training including where the new job role is not related to the apprenticeship, the apprentice may complete any remaining elements of the apprenticeship assessment in agreement with the assessment organisation and the provider, so long as the remaining elements of the apprenticeship assessment (as outlined in the assessment plan) can be successfully delivered and funded.

351.3. Providers must contact apprenticeship service support to get approval to report this change to us and to receive the technical details for claiming the completion payment.

You could probably ask as you have to contact the Apprenticeship Service to do this anyway.

Thanks Ruth! I agree with the not doing another training plan as the practical period is complete. The new role with the new employer is related to the apprenticeship so I won't have to contact the DfE for approval in this case. However, there is one outstanding on program payment as the apprentice has completed practical one month earlier than planned!

I wonder if the ILR will allow to put new TNP 3 and TNP 4 in the financial record with a start date after the learning actual end date...

Oh yeah, of the new employer is taking on responsibility for outstanding funding, they do have to pick up some OPP payments if they finished early 🙁 We had one of those once, but the new employer was ok with it.

I think the TNP 3 and 4 should be ok after the AED, I'm sure we must have done it before. If it errors, you'd have to ask the helpdesk how they suggest you code it!
