Marvellous - thanks Martin West. We do have them declare this and I assumed it would be sufficient, I just wondered if there was any formal requirement to retain tangible 'proof' in case of audit as a result of Brexit, but I presume not!
Leave it there if I were you Ben otherwise you'll give Steve H a reason to send you an explicit response explaining whyou dont have to have "proof". Also if it says there's no restrictions that possibly implies they have ILR (Indefinite Leave to Remain), which is exempt from the 3 year residency requirement

If we've seen a prospective apprentice's permanent residence card which states there are "no restrictions on the holder's activity in the United Kingdom" are we still under obligation to see if they've been a normal resident for the last 3 years? If so, what kind of 'proof' is required for this? Is a self-declaration that they've been here for 3 years sufficient?
