In case you hadn't spotted it, the "Coverage of the ILR" section of the ILR rules has changed for 26/27.

For many years we've had this statement: "FE colleges must also send details of all learners who are not in receipt of public funding from the ESFA (apart from learners subcontracted in from a school or Higher Education Institution)."

That has been removed from the 26/27 ILR Spec. This was a deliberate decision after this discrepancy between Colleges and other providers was raised with DfE. Does this mean we no longer need to report any subcontracted IN delivery?

If you have a relationship with OfS, they are entitled to audit all of your L4 aims, whether recognised HE or not. Obviously recognised HE that would be in your HESES has to be in the ILR, but if you have some unfunded L4+ content that's not recognised HE or Advanced Learner Loan Funded, that's a bit of a grey area. OfS do put you in a fee band based on your total L4+ FTE (including the non-recognised delivery), so if you have a significant amount of L4+-but-not-recognised delivery, excluding it from the ILR could have an impact on the fee you pay (plus they wouldn't audit it). I don't know what OfS think about that, or whether than can insist that we report all our unfunded-L4+-but-not-recognised delivery in our ILR.
