Withdrawal & EHCP

We have a learner who has never attended any learning on their study programme but has a EHCP. Can they be withdrawn ? I am being advised by college staff they can't, by law, as they have an EHCP. It seems wrong for them to count in our lagged funding calculations.

Can anyone advise please.

"By law", as if, where do people get these ideas from?

If they haven't turned up, they get withdrawn, end of discussion. Now, should the appropriate LA be involved in discussions about what is happening to this young person? Absolutely, but that's got nothing to do with our ILR data.

Our Learning Support team tells us this. We compromise and put them on an admin code that doesn't go in the ILR. The student is "enrolled" as in still on our radar, but we follow the DfE rules. It means nothing really, but it keeps Learning Support happy.
