Forgot what you call them: If they are delivering and they are not under your own control its subcontracting
Just to add im not disagreeing with @martin
If they work for the provider but they get work as and when they are unlikely to be a Subcontractor as long as they are under the direction and control of the provider.

As we know associates would count as a subcontractor.
Would having someone on a 0 hour contract be acceptable and so not be classed as a subcontractor?
