T Levels and Employment Status

We're getting ILR error EmpStat_11 for our T levels students, because they have no Planned Hours. I don't think they should require an Employment Status record, as they are 16-17 and full time. What have others done with this, and has anyone spoken to ESFA about getting T levels excluded from this rule? We're just putting in Not Known records for now. The details are;

If the Learning aim start date is on or after 1 August 2014 (LearningDelivery.LearnStartDate => 2014-08-01), and the provision is 16-19 non-apprenticeship (LearningDelivery.FundModel = 25 or 82), and the total of the Planned learning hours and the Planned employability, enrichment and pastoral hours is less than 540 (sum of (Learner.PlanLearnHours and Learner.PlanEEPHours) < 540), there must be an applicable Employment status record

(error where there is no Employment status record where LearnerEmploymentStatus.DateEmpStatApp < LearningDelivery.LearnStartDate)

(This rule is not triggered by traineeships  (LearningDelivery.ProgType = 24))
