Hi, 

We have a learner who has been on an apprenticeship with another provider and is now transferring to us, it is the same standard, as 4 months of funding has previously been claimed by another provider we have had to reduce the TNP and the minimum duration, our planned end date now doesn't meet the minimum duration, which appears to be okay with regards to the funding rules: 

Episodes of learning below the minimum duration requirement P39 The only circumstances in which an episode of apprenticeship learning can fall below the minimum duration requirement are where an apprentice:

Transfers between main providers but remains on the same standard;

To reflect this is in the ILR do i complete as normal with our reduced duration and tnp but click restart button and add the original learning start date? Please also let me know if there is anything else that i have not taken into consideration? Any help would be appreciated.

For a restart that wasn't a return from a BIL with your own organisation, you tick Restart, but you don't include the original start date. That goes for change of provider, or a restart when they didn't have a formal break, or perhaps had a gap between employer of more than 30 days (non-redundancy) so you had to withdraw.

The only other thing to watch out for with transfers from other providers, is your reduced price. Check on the co-investment report and apps monthly payment report to make sure the price you're charged isn't above the band maximum minus what the first provider had. The employers have sometimes been given different dates than what the first provider was actually reporting in their ILR, so our calculations weren't right.
