Apprentice Withdrawal at Gateway

Hi Everyone

What are the cost implications of an apprentice leaving at gateway, both to the provider and employer?

We have an apprentice who is considering leaving their programme at gateway if they don't meet the requirements, given they can finish their non-mandated qualification outside of the apprenticeship.

We haven't come across this before so all advice welcome

It would be a withdrawal for you and would be connected to their LDIL.

It seems odd to give advance warning of withdrawaling, unless through redundancy. Is there a reason why they dont want to continue?

For the Provider they would lose the 20% completion payment and any monthly payments where the withdrawal is prior to the planned end date. There would be no direct cost implications for the Employer.

This will also have a detrimental effect on the providers QAR and the Apprentices PLR would also indicate a failure.

Kelly Knights They can sit the qualification outside of the apprenticeship (it's non-mandated, but huge overlap with knowledge in standard). So employer is arguing that if they can't meet apprenticeship requirements at this stage they can drop off and get the qual anyway.
Martin West Thank you for confirming - I thought as much. Helpful to point out to apprentice about PLR that may affect their decision.

Do either of you know whether we can recover any of the 20%, for example as an exit charge or similar?

Hi Jessica,

It would go back to your contract and schedule with the employer. If its not mentioned than potentially not.

We often have learners that complete their mandatory qual first and then refuse to complete the apprenticeship  - it hits us hard on achievement rates and the employers often do sod all.

Hi Martin,

Following on from this - we have a leaner being signed up with a college and they have stated in their paperwork as a Levy employer if an Apprentice leaves we would be liable for the remaining costs and the 20% completion payment - this doesn't feel right and isn't anything i have come across before while working in training or with other organisations.

I am not sure I fully understand as a learner cannot be signed on by a College when they are undertaking an Apprenticeship.

Hi Martin, 

Sorry the college is delivering the apprenticeship, they have put it in their sign up paperwork - that we are the employer will be liable if they leave before completion.

If you do not like their contract terms then do not sign it, you can always find a provider who does not include this in their contract.

I do not know how many providers are including this in their contracts or if it is legal but cannot find anything in the funding rules that rules this out.

Thank you for that - i couldn't find anything specific either - obviously aware we cannot then cascade that down to the apprentice.
