If they're still engaging (and happy to do so) I don't think I would BIL them? I'd be having a discussion with them about how many hours of OTJ they can do if they're *not* in the workplace (it might actually be more than usual!!!) but someone on sick leave is still employed, so there's no big deal about them staying on programme? There's no *requirement* for someone on the sick for more than four weeks to go on a BIL.
You definitely can keep someone on programme when they're not technically working. We had several during the big lockdowns. They couldn't technically go to work, but were still being paid, and continued with delivery/learning that met the 20%, and they logged it all.
We also had vice versa, apprentices who were working through lockdown, but became too busy to keep up with 20% OTJ, so went on a BIL whilst still actually working. They restarted when things at work calmed down.

We have a situation with a learner. He’s currently off from work due to a physical injury. He’s still engaging with his apprenticeship work, but as he’s effectively on sickness absence (and has been for a few weeks) how do we stand with the apprenticeship and the learning considering if someone is on sickness absence for 4 weeks or more they should go on a BIL (aware it must be the learner that ultimately makes this decision and the employer must agree).
Is it the case that if you are signed off from work due to anything (sickness or physical injury) that person should be ‘signed off’ from the apprenticeship?
