Change of Employer, how to record on ILR

Hello,

I just want to check that this is going right! When a student changes employer, gap in learning less than 30 days, paperwork is all done properly, what do you record on the ILR apart from the new employer ERN number (if you have it).

The MAS is all upto date and employer 1 has stopped on the right date with employer 2 picking it up straight away.

If there is a change to the apprentice’s employer during their programme, then you must record a new Learner Employment Status record to reflect this.

A new Apprenticeship contract type FAM record must be added if the new employer has a different apprenticeship contract type to the previous employer, for example if the apprentice has changed from an employer who is funded through a contract for services with the employer, to an employer who is funded through a contract for services with the ESFA that does not have an account on the apprenticeship service, then a new FAM record with ACT2 must be recorded.

There should be no changes made to the learning aims.

You must record a new price record on the programme aim; this price must reflect the cost of the remaining amount of the programme to be delivered with the new employer. This residual cost must be recording using AFinCode = 3 for training and AFinCode = 4 for assessment, as applicable.

Similar problem. I have a student who stopped with his employer in July 22 (21-22) but restarted with a new employer in August 22(22-23) . This is reflected in the MAS. Do i do as Ben James has mentioned above or do i withdraw the student in 21-22 and restart in 22-23.

Process wise, it depends on the gap in employment, but the PSM will help;

  • 30 days or less, follow P342
  • more than 30 days, follow P345

The guidance above relates to what the ILR needs to say on either the existing record (if not terminated because <=30 days) or the new record (if terminated/restarted because >30 days).

Worth noting this is slightly different where the break in employment occurs post August 2022 and is more than 30 days, but as the end date of your example was pre-August 2022, I referenced the previous funding rules.

Hi,

I have two learners who have changed employer, one of which (learner A) has resulted in a DLOCK and I have no idea how to fix it.  The other I am about to make changes on the ILR but thought I would ask for guidance as any answer might help me fix the first one!  I am using the learner entry tool from the ESFA.

Learner B ended her employment on 31/10/2024 and started with the new employer on 1/12/2024.  I think I am ok with adding a new employer, using the generic code 999999999.  I can also calculate the new TNP3 and TNP4.  What I am not sure about is whether I need to change the ACT.  Both companies are levy payers.

For learner A the DLOCK is 07, but I have changed the employer status and added the new employer.  Complete loss there I'm afraid.
