Non levy not added on DAS in time

Morning all - me again.

So I have a non levy employer who has just added a learner onto DAS despite months of emails chasing them. Learner started in May but was added yesterday so will now fall under new ESFA rules. My question is, if I amend ILR to match DAS will I need to input RPL and amend OTJH as well as reduce the overall apprenticeship length and TNP?

I suspect the answer is yes, but would like some advice.

BTW I have spoken to my employer and told them I want a new process put in place whereby learner is added to DAS prior to start up going forward.

You won't need to apply RPL (unless there are FS aims to be re-added), but any OTJ hours the apprentice completed prior to the start date the employer has used in DAS (and subsequently the date you're going to be using on the ILR) won't count towards the total. You'll need to recalculate the minimum OTJ requirement based on the 'new' start date and new rules, and ensure your paperwork reflects this, and the revised dates too.

Whether or not you adjust the TNP is up to you, but on the basis that you've delivered the training already, and it's not your fault the employer has only just added them, I don't see why you should. Changing the TNP to account for the shorter ILR duration (and reduced number of KSBs that will need to be taught over this revised period) would also require a change to your contract for services with the employer so I'd personally consider leaving it as is, in which case you'll get the same money just over a shorter period. Though this will be a business decision you'll have to make.
