Just trying to confirm my understanding of OTJ for term-time only. From rules, says OTJ can be delivered in term-time if agreed with employer/provider but will require more than 6 hours per week to meet the minimum. Given that OTJ cannot be delivered during the holiday, can there be any exception to this? i.e. what happens if the employer does not agree to more than 6 hours per week during term time?

P47.1 Off-the-job training is calculated as though the apprentice is working 52 weeks per year (minus statutory leave). Once the calculation is made, the training can be delivered across the weeks specified in the term-time only contract (usually 39 contact weeks), if this is what has been agreed between the employer and main provider.

P47.2 This will mean delivering more than an average of 6 hours per week (for a full-time apprentice) during term-time, in order to meet the minimum requirements of the off-the-job training policy.

Hmmm, if the employer doesn't agree then the App won't meet the minimum hours and then, y'know, you can't have any funding...

I *guess* learner and employer *could* agree that training would take place outside of their 39 week (or whatever) contract? Seems unlikely (personally, wouldn't work with an employer who was doing that...)

Thanks, Steve, that is what I was thinking, and that if they *agreed* training outside of term-time then really that would be need to be paid for or given in lieu to be valid OTJ.

Oh, good point, it would be outside their contracted hours, so yes, TOIL would be needed!
